Quiz - Fiqh (Taharah)

Sorry la about all these quizzes. They are for me actually coz like everyone else I proofread and read my own blog hehehe. Currently we are revising for the oral/viva exam. In the meantime I thought others can benefit from reading these as well.

Tayammum
1. What was the story behind the revelation of the permissibility of tayammum?
2. If you don't have water but there is some water that is in someone else's land, can you take that water to make wudhu' or must you make tayammum?
3. Does tayammum expire when the prayer time expires?
4. If you are praying (with tayammum) and suddenly it started to rain, do you continue praying or must you stop and take wudhu'?
5. What if you only have enough water to make partial wudhu'?


Ghusl/Janabah
1. Must a new Muslim make ghusl when he embraces Islam?
2. What are the different opinions regarding the ghusl on Friday?
3. Is it permissible for the husband and wife to make ghusl together?
4. If a woman has long hair, does she need to wet all of her hair during ghusl?

1. about Aisyah losing her necklace in one of the expeditions. Rasulullah saw in all patience waited until the necklace was found yet it was not. and the expedition had to sleep over because of this. And they had no water. The next fajr Allah revealed the verse of tayamum. pastu jumpa necklace bawah camel i rasa.

wiping over khuf/ socks/ shoes

1. it is an act of worship to just obey.
2. i. already has a wudhu before wearing them.
ii. for a traveller expiry date is 3 days. for resident is 1 day
iii. the khuf/ sock/ worn must cover the wudhu part. and not transparent

Tayammum
1. What was the story behind the revelation of the permissibility of tayammum?

3. Does tayammum expire when the prayer time expires?
No it doesn’t. Tayammum is equal to wudhu’ therefore whatever nullifies the wudhu’ nullifies the tayammum. Prayer time expiring does not nullify the wudhu’ so it does not nullify the tayammum.
The hadith that states tayammum expires when the prayer times expires is a very weak hadith.

4. If you are praying (with tayammum) and suddenly it started to rain, do you continue praying or must you stop and take wudhu'?
Stop praying, take wudhu’ and pray again.
Narrated Abu Hurairah that Rasulullah SAW said “The soil is a means of ablution for the Muslim even if he does not find water for 10 years. But when he finds water he should guard against disobeying Allah and let it touch his skin” (AlBazzar)

If however you have prayed and then find water after the prayer, there is no need to repeat that prayer. Based on hadith of Abu Said AlKhudri about 2 men who set out on a journey. They had prayed with tayammum. Then after the prayer (but prayer time still had not expired), they found water. One of them didn’t repeat the prayer and one of them repeated the prayer. Rasulullah said the former followed the sunnah.

5. What if you only have enough water to make partial wudhu'?
Opinion of scholars
- Try and make the minimum wudhu’
- If not able to; either drink the water/throw it away and then make tayammum 

Ghusl/Janabah

1. Must a new Muslim make ghusl when he embraces Islam?
Some scholars are of the opinion that it is wajib based on the hadith
Narrated Abu Hurairah on the story of Thumamah ibn Uthal, when he embraced Islam the Prophet told him to take a bath (ghusl) – Narrated by AbdurRazzaq, basic meaning from Bukhari & Muslim
However majority of scholars maintain that it is mustahab because:
1. The Prophet did not give any order for new Muslims to make ghusl when he sent Muadz bin Jabal as a dai’
2. The Prophet did not give any order for new Muslims to make ghusl during the conquest of Makkah

2. What are the different opinions regarding the ghusl on Friday?

Zahiri scholars- it is fardh to make ghusl on Friday
Narrated Abu Said AlKhudri- Allah’s Messenger said “Taking a bath of Friday is obligatory for every adult” (Bukhari, Muslim, Abu Daud, AtTirmidzi, An-Nasaie, Ibn Majah, Ahmad)

Shafie, Maliki, Hanafi, Hanbali scholars- it is mustahab
Narrated Samurah, Allah’s Messenger said “Whoever performs ablution on the day of Friday has done a good thing and whoever takes a bath, indeed the bath is better” (Abu Daud, Tirmidzi, Nasaie, Ibn Majah, Ahmad)

Sheikhul Islam Ibn Taimiyah attempted to reconcile these hadith and is of the opinion that if you are dirty or smelly, then it is wajib to make ghusl on Friday as you will be attending a congregation of many people and you do not want to discomfort others by your smell and appearance.

3. Is it permissible for the husband and wife to make ghusl together?
Yes. Allowed to even share water and look at each other’s private parts.
Narrated Aishah: I and Rasulullah SAW would take a ghusl from janabah from the same vessel and our hands alternated in scooping water from it. (Bukhari & Muslim)

All hadith regarding impermissibility of looking at one’s spouses’ private parts, causing weak eyesight or that Aishah never looked at Rasulullah’s private parts are either weak or false.

4. If a woman has long hair, does she need to wet all of her hair during ghusl?
No.
Narrated Umm Salama: I said O Rasulullah, I am a woman with tighly plaited hair on my head, should I undo it for taking ghusl for janabah (or menstruation)? He SAW said: “No, it is enough for you to throw 3 handfuls of water on your head. (Muslim)

Wiping of khuffain/socks/shoes

1. Why is the issue of wiping the khuf also considered an aqidah issue?

Because only Ahl Sunnah wal Jama’ah hold it permissible based on mutawatir ahadith (more than 80 narrations including from the ten sahabi promised Jannah). To deny the permissibility of wiping over the khuf would be denying the authenticity and credibility of more than 80 sahabi. If one denies it, then what more of the other hadith related by the same sahabi with regards to aqidah? As only mutawatir hadith are accepted for rulings in aqidah. Shi’ah and Khawarij do not allow wiping over the khuf.

2. What are the conditions of being able to wipe over the khuf?

a. Putting them on in the state of taharah. E.g. take wudhu’ then put on the khuf/socks/shoe. Therefore cannot wash right foot then wear right khuf. Must be in complete wudhu’ before putting both on.

Narrated AlMughirah bin Shu’bah: Once I was in the company of Rasulullah SAW. He then performed wudhu’ and I reached down to take off his socks. He said: “Leave them for I have put them on in a state of purification. So he wiped over them. (Bukhari & Muslim)

b. Only wipe the upper portion, even so no need to wipe all of the khuf. Wiping majority of the area on the khuf is sufficient.

Narrated Ali: If the religion were based on opinion, it would be more fitting to wipe the under parts of the khuf rather than the upper. However I have seen Rasulullah wiping over the upper part of his socks. (Abu Dawud)

*This is also proof that religious commands and prohibitions are based on revelation and not the opinions of men.

c. For women, the socks must cover the aurah and not be of a transparent kind.
d. Must take the socks off if one has to perform ghusl

Some scholars state that the khuf must follow certain conditions like they must not have any holes, can walk 3km in them without tearing. But this is not mentioned in the shariah. The sahabi were men of poverty, their khuf would definitely have had holes in them. As long as something can be called a sock/khuf, then it is permissible to wipe over it.

Pearls of wisdom: If you are wearing socks, is it better to take it off and wash the feet or wipe over the socks?

Rasulullah would not leave something that is better. He always wiped over his khuf. So if you are wearing one, then the best option (afdhal) is to wipe over it.

3. Is wiping the khuf only allowed in cold countries and if there is difficulty?
No, it is a concession (rukhsah) for all Muslims at any time. It is not attached to need/difficulty.

4. How long is the duration of permissibility of wiping the khuf?
a. For the musafir (traveller). 3 days 3 nights (72 hours)
b. For the muqim (resident) 1 day 1 night (24 hours)

Narrated Ali: The Messenger SAW fixed the period of wiping over the khuf, for 3 days 3 nights for a traveler and one day one night for the resident. (Muslim)

5. With regard to question 4, when does the time begin? When one puts on the khuf, when one's wudhu' is first nullified after wearing the khuf or the first time one wipes the khuf?
As Lollies answer.
Ahmad is a resident. He wakes up at 6am, performs wudhu’ for Fajr then puts on his socks/khuf. At 11am his wudhu’ is nullified. He then takes wudhu’ (and wipes his khuf) at 1pm for Zuhr prayer.
So his 24 hours start from the first time he wiped his khuf i.e. 1pm.

Menstruation

1. When can the women in istihadhah join her prayers?

Only when she follows that it is mustahab to make ghusl before the prayers. Therefore she makes ghusl for Fajr, ghusl for Zuhr & Asr, ghusl for Maghrib and Isha’. This is the method Rasulullah preferred the most.
If she does not make ghusl for each group of prayer, then it is not allowed for her to join the prayers. Instead she must make ablution for each prayer and pray them at their appropriate times.
Ruling based on 3 long hadith.

2. How do we tell the difference between haidh and istihadhah?

- the colour of the blood
- if it is different from one’s normal routine
- if a person does not have a normal routine, then if the timing of the bleeding is different to other family member’s normal routine
There is no fixed time to differentiate between haidh and istihadhah. Every woman has a different period.

3. What is the ruling for women who have miscarriages? Are they in istihadhah or nifas?

If the miscarriage occurred before 90 days gestation (foetus fully formed), then the ruling is of istihadhah – must pray, fast etc
If the miscarriage occurred after 90 days gestation, then the ruling is of nifas. No need to pray/fast or replace the prayers missed.

4. If Maghrib time is 6pm and the woman becomes tahir (clear of menses) at 5.55pm, does she still need to pray Asr?

As Lollies’ answer. Yes, according to majority of scholars.

5. Does vaginal discharge break wudhu'?
There are different types of vaginal discharge, but the clear discharge (not blood of menses, not istihada, no mani/mazi etc) and a mere moist discharge that naturally occurs -this breaks ones wudhu according to the majority of the ulama but it is not najis. Therefore there is no need to wash it off.
